Privacy Policy

Cheerio Technologies Private Limited (“Cheerio”, “we”, “us”, or “our”) operates the Cheerio software platform, including our websites cheerio.in, cheerioai.com, app.cheerio.in, web.cheerio.in, and our official mobile apps on iOS and Android (collectively the “Service”).

This Privacy Policy explains how we collect, use, store, share, and protect your personal information in compliance with:

  • the General Data Protection Regulation (GDPR) (EU 2016/679),

  • the California Consumer Privacy Act (CCPA), as amended by CPRA, and

  • the Digital Personal Data Protection Act 2023 (DPDP Act) of India.

By using our Service, you agree to the terms of this policy. If you do not agree, please discontinue use.

1. Information We Collect

We collect and process information necessary to deliver and improve our Service, including:

  • Account Information: name, email address, and (optionally) phone number.

  • Login Credentials: for authentication through Google, Facebook, or mobile number (where applicable).

  • Profile & Uploaded Data: profile image, uploaded media, contact lists, and message data you voluntarily provide.

  • Technical Data: device name, IP address, OS version, app configuration, crash logs, and timestamps (via analytics tools).

  • Cookies and Tracking: some third-party tools use cookies or similar identifiers for analytics and security.

We do not collect financial or biometric data.

2. How We Use Your Information

Your personal data is used to:

  • Operate, maintain, and improve our Service;

  • Provide support and respond to inquiries;

  • Communicate updates, new features, or security notices;

  • Send marketing or promotional messages (via email, WhatsApp, or SMS, with opt-out available through “unsubscribe” links or request to admin@cheerio.in);

  • Enforce our terms and comply with legal obligations.

We do not sell personal information. We share it only as described here.

3. Legal Bases for Processing (GDPR)

If you are in the EEA or UK, we rely on these lawful bases:

  • Consent,

  • Contract performance,

  • Legal obligation, or

  • Legitimate interest (balancing your rights and freedoms).

4. Data Retention

We retain personal data for up to 5 years after account deletion or last activity, solely for backup, legal, or compliance purposes. When data is no longer needed, we permanently delete or anonymize it.

5. Sharing and Third-Party Service Providers

We share data only with trusted processors who support our Service and comply with data-protection standards. These include (but are not limited to):
AWS S3, Google Analytics, Firebase, Mixpanel, Segment, Facebook Business API, Meta Graph API, Amplitude, Aisensy, and Karix.

Each third-party provider processes information only under our instructions and for the purposes of hosting, analytics, delivery, or communications.
Data may be transferred to AWS data centers in Mumbai, the US, or Europe, wherever local data localization or redundancy applies.

6. Security

We protect personal data using AES-256 encryption, SSL certificates, and other technical and organizational safeguards. However, no method of internet transmission or storage is 100 % secure, and we cannot guarantee absolute security.

7. Your Rights (GDPR / CCPA / DPDP Act)

Depending on your jurisdiction, you may exercise the following rights:

We will verify your identity and respond within 30 days of receipt.

8. International Data Transfers

We may process data on servers located outside your jurisdiction (e.g., India, US, EU).
All transfers are subject to appropriate contractual and technical safeguards (including Standard Contractual Clauses) to ensure equivalent data protection under GDPR and DPDP Act.

9. Children’s Privacy

Our Service is not directed to children under 13. We do not knowingly collect data from them. If you believe your child has shared personal information, please contact us for deletion.

10. Changes to This Policy

We may update this Privacy Policy periodically. Updated versions will appear on this page with a new effective date.
Significant changes will be communicated via in-app notification or email.
